Ervin knew history and the Constitution very well. He agreed that presidents did have executive privilege, but not the kind Nixon claimed. Ervin argued that the president had the power to keep communications secret only when he was doing his official duties. That power did not apply to “illegal or unethical or political activities.” And it did not allow any president to withhold material that dealt with crimes under investigation. Ervin said that wasn’t executive privilege at all. It was “nothing but executive poppycock.”77 And if Nixon did withhold that kind of material, it would put the president above the Constitution.78
